Terms and Conditions (Online Personal Training)

1. Authorization. The client agrees to engage Endorphin Junkie Fitness, a sole proprietor, located at 15 Galtres Road, York YO31 1JP, England, as an independent contractor for the sole specific purpose of health and fitness personal training. This agreement excludes personal or lifestyle advice that is not connected with health and fitness.
2. Services. Endorphin Junkie Fitness agrees to provide online personal health and fitness training on a monthly basis and to devise a periodized program based on the information gathered on the Lifestyle and Health Screen, any additional verbal information, Agreed Program Goals and Program.
3. Information. The client agrees to supply Endorphin Junkie Fitness with health and fitness related information to enable safe and effective activity sessions to be designed and undertaken. The client further agrees to advise Endorphin Junkie Fitness of any changes in that information that may affect the activity sessions. All of the information will be treated with strict confidentiality.
4. Risk. Any exercise program carries with it an element of risk. The activity sessions will be designed to minimize the risks whilst providing an effective cardiovascular or resistance workout. The client agrees to inform the instructor if for any reason (such as illness or injury which might be aggravated by exercise, undue pain or excessive discomfort) they should not participate in an activity. The client is free to withdraw from any activity at any time.
5. Payment of Fees. Fees to Endorphin Junkie Fitness are due and payable on the following schedule: GBP 10.00 in monthly instalments via credit/debit card or Direct Debit. All payments must be made in UK Pounds Sterling (GBP).
6. Overdue Fees. In order for Endorphin Junkie Fitness to remain in business, payments must be made promptly. Default fees of 15 days after their due date will incur an additional 5% penalty added to the total invoice amount and for each month of non-payment thereafter. Endorphin Junkie Fitness reserves the right to withdraw online services until final payment is made. In case collection proves necessary, the client agrees to pay all fees incurred by that process.
7. Cancellation of Online Services. The client agrees to give notice of the cancellation of services via telephone or email.
8. Sole Agreement. The agreement contained in these Terms and Conditions constitutes the sole agreement between Endorphin Junkie Fitness and the client regarding health and fitness personal training. Any additional work not specified in this agreement must be authorized by a written change order. All prices specified in this agreement will be honoured for the agreed period of online services after accepting this agreement. Continued services after that time will require a new agreement.
9. Legal. This agreement was entered into under laws governing England and Wales and any dispute will be litigated or arbitrated in England and Wales. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Privacy Policy

1. Information Collection and Use - Endorphin Junkie Fitness is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. Endorphin Junkie Fitness collects information from our users at several different points on our website.
2. Order - We request information from the user on our contact form. Here a user must provide contact information (like name and email address). This information is used for communication purposes and to fulfill customer's requests. If we have trouble processing a request, this contact information is used to get in touch with the user.
3. Cookies - In common with most other websites, when you visit our website a "cookie" (a type of code) is downloaded to your computer. This allows us to identify your computer (not you as an individual) and to develop our services by tracking when and how you use the website.
4. Log Files - We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.
5. Sharing - We may share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person. We may use a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. We may partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services
6. Links - This website contains links to other sites. Please be aware that we, Endorphin Junkie Fitness, are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy policies of each and every website that collects personally identifiable information. This privacy policy applies solely to information collected by this website.
7. Security - This website takes every precaution to protect our users' information. When users submit sensitive information via the website, your information is protected both online and offline.
8. Site and Service Updates - We also send the user site and service announcement updates. Members are not able to un-subscribe from service announcements, which contain important information about the service. We communicate with the user to provide requested services and in regards to issues relating to their account via email or phone
9. Correction/Updating Personal Information - If a user's personally identifiable information changes (such as your zip or post code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us.
10. Notification of Changes - If we decide to change our privacy policy, we will post those changes on our Homepage so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
